Under Louisiana law, you must carry liability coverage on any automobile you own. This coverage pays for property damages or personal injury for which you may be legally responsible, up to your policy’s dollar limits. In Louisiana, each vehicle is required to have 15/30/25 liability limits. Those limits provide payments of $15,000 for bodily injury to one person, $30,000 for bodily injury to more than one person in a single accident, and $25,000 coverage for damage to someone else’s vehicle or other property.
After a crash, bring your declarations page and any UM selection or rejection form to your consultation. Our team can review your coverage and explain the next steps.
Uninsured Motorist Insurance (UM), sometimes referred to as bodily injury insurance, pays for medical expenses, lost wages and pain & suffering due to bodily injury as a result of an accident with a motorist that is uninsured.
UM can also protect you and passengers if the accident involves a hit-and- run driver.
Underinsured Motorist insurance (UIM) is much like UM ,but refers to a motorist that has coverage but not enough to cover all injuries.
Louisiana generally includes UM coverage at bodily injury liability limits unless properly rejected or modified on the prescribed form. Commercial policies follow a separate selection rule. See R.S. 22:1295.
FAQ Uninsured / Underinsured Motorist Coverage
-
Can I make a claim against an uninsured/underinsured motorist auto insurance policy if I was not the driver?
Possibly. Passengers and other insured people may qualify. Coverage depends on the policy’s insured-person definitions, exclusions, and crash facts.
-
What is the minimum protection coverage for an uninsured/underinsured motorist auto insurance policy?
Standard UM bodily injury limits cannot fall below Louisiana’s $15,000 per person / $30,000 per accident minimum, unless economic-only coverage is selected. Coverage may also be rejected.
-
What is “economic only” and property damage uninsured motorist coverage?
Economic-only UM covers economic losses, such as medical expenses and lost wages, but excludes noneconomic losses such as pain and suffering.
UM property damage coverage is separate. The statutory option applies when the policy lacks collision coverage, carries a $250 deductible, and caps coverage at actual cash value or $25,000, whichever is less.
-
What are the penalties to an uninsured motorist?
Driving without required coverage can lead to impoundment, registration consequences, and fees under R.S. 32:863.1. Louisiana’s current “No Pay, No Play” law, R.S. 32:866, generally bars an uninsured owner or operator from recovering the first $100,000 of bodily injury damages and the first $100,000 of property damage. Exceptions apply, including protections for qualifying non-owner passengers and legally parked vehicles. The crash date and facts matter; ask us to review your situation.
